ORDER granting in part and denying in part 28 Motion for Summary Judgment. For the reasons set forth in the attached Memorandum and Order, defendant's motion for summary judgment is granted in part and denied in part. Specifically, plaintiff's claim for recovery in quantum meruit is dismissed.
