ORDER granting 95 Motion for Summary Judgment; finding as moot 110 Motion to Strike. For the reasons set forth herein, the Court grants summary judgment with respect to the federal claim. The Court declines to exercise supplemental jurisdiction over the state law claim, and dismisses that claim without prejudice. Finally, defendant's motion to preclude evidence is denied as moot.
