ORDER: SO ORDERED that plaintiffs application to proceed in forma pauperis isgranted and his application for the appointment of pro bono counsel is denied without prejudice to renewal when this case is ready for trial, if so warranted at that time. The Clerk of the Court is directed to forward copies of the summonses, the complaint, this Order and the Notice of Hearing dated October 22, 2014 to the USMS for service upon defts without prepayment of fees and, pursuant to Rule 77(d)(l) of the Federal Rules of Civil Procedure, to serve notice of entry of this Order upon plaintiff in accordance with Rule 5(b) of the Federal Rules of Civil Procedure and record such service on the docket. The court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal. OPINION & ORDER granting 25 Motion to Dismiss for Failure to State a Claim. SO ORDERED that for the reasons set forth above, so much of Dr. Martin-Naars motion as seeks dismissal of plaintiffs claims against her pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure is granted and plaintiffs claims against Dr. Martin-Naar, and ADA claims against all defts, are dismissed in their entirety with prejudice for failure to state a claim for relief. There being no just reason for delay, the Clerk of the Court shall enter judgment in favor of Dr. Martin-Naar on plaintiffs claims against her pursuant to Rule 54(b) of the Federal Rules of Civil Procedure. Pursuant to Rule 77(d)(1) of the Federal Rules of Civil Procedure, the Clerk of the Court shall serve notice of entry of this order in accordance with Rule 5(b) of the Federal Rules of Civil Procedure.
