ORDER: SO ORDERED that Magistrate Judge Tomlinsons Report is accepted in its entirety, and, for the reasons set forth therein, the branches of defts motion seeking judgment dismissing plaintiffs claims alleging deceptive trade practices in violation of N.Y. Gen. Bus. Law § 349 and unjust enrichment pursuant to Rule 12(c) of the Federal Rules of Civil Procedure are granted; plaintiffs claims alleging deceptive trade practices in violation of N.Y. Gen. Bus. Law § 349 and unjust enrichment (Counts Six and Eight, respectively) are dismissed in their entirety with prejudice; and defendants motion is otherwise denied. The parties shall appear before me in Courtroom 1010 at the Central Islip Courthouse, located at 100 Federal Plaza, Central Islip, New York 11722, for a status conference on March 23, 2016 at 11:15 a.m..
