MEMORANDUM & ORDER Tibor Klein (1), Robert Schulman (2) - For the reasons set out above, the Court (1) grants the governments motion to preclude the admission of evidence concerning the SEC complaint and charging decision; (2) grants the governments request to introduce evidence concerning the relationship between the defendants, insofar as such evidence includes no mention of the SEC complaint or charging decision; (3) denies Schulmans motion to preclude a gift theory; and (4) denies Schulmans motion for the Court to supervise the disclosure of Brady and Rule 3.8 materials. A conference before the Court is hereby scheduled for February 21, 2017, at 1:00 PM in courtroom 6E of the Brooklyn courthouse. On or before February 17, 2017, the parties shall file proposed voir dire and jury instructions via ECF. So Ordered by Judge Joan M. Azrack on 2/10/2017. MEMORANDUM & ORDER deferring ruling on 60 Motion in Limine as to Robert Schulman (2); granting 61 Motion in Limine as to Robert Schulman (2). For the reasons above, the Court (1) defers ruling on the admissibility of Schulmans statements in response to the April 2011 inquiry by the Financial Industry Regulatory Authority; (2) grants the governments request to introduce Schulmans out of court statements; and (3) grants in part and denies in part Schulmans request for the admission of additional statements pursuant to Federal Rule of Evidence 106, as indicated herein.
