MEMORANDUM OF DECISION & ORDER granting in part and denying in part 14 Motion to Dismiss; granting in part and denying in part 16 Motion to Dismiss for Failure to State a Claim. The Defendants' Instant Motions to dismiss the Plaintiff's complaint pursuant to Rule 12(b)(6), are granted in part and denied in part. They are granted to the extent that the Plaintiff's fourth and fifth causes of actions are dismissed. The Plaintiff is precluded from advancing a negligence per se or trespass claim against the Defendants. The Instant Motions are denied to the extent that the Plaintiff's remaining causes of action may proceed. SEE ATTACHED DECISION for details. SO ORDERED by Judge Arthur D. Spatt on 3/29/2018.
