AMENDED JUDGMENT: Amendment to the # 21 Judgment. It is ORDERED that Defendants' # 5 Motion to Substitute the United States of America as the sole defendant in this action and to dismiss the action is GRANTED, and the action is DISMISSED WITHOUT PREJUDICE. Plaintiff's motions, dkt. # 18 Letter Request and dkt. # 19 Letter Request are DENIED AS MOOT. It is further ORDERED that Plaintiff's motion to amend the January 29, 2016 Decision and Order [Dkt. # 20] and January 29, 2016 Judgment [dkt. # 21] such that the dismissed claims against Nancy A. Caffrey, R.P.A.-C, Moses-Ludington Hospital, and Inter-Lakes Health, Inc. be remanded to state court, [dkt. # 22 and dkt. # 24], is GRANTED. The claims solely against Nancy A. Caffrey, R.P.A.-C, Moses-Ludington Hospital, and Inter-Lakes Health, Inc. are REMANDED to the New York Supreme Court, Warren County. Claims against, or that include, Toni M. Strum, M.D., are not remanded. The Court offers no opinion as to whether Plaintiff should be allowed to amend the Complaint's Fifth or Sixth Causes of Action (which are against all defendants) in the New York State court. All of the above pursuant to the Orders of the Honorable Senior Judge Thomas J. McAvoy, dated the 29th day of January, 2016 and the 23rd day of May, 2016. (mc)
