ORDER granting in part and denying in part 16 Motion for Summary Judgment. The Title VII retaliation claim against the District and the Board in the First Cause of Action, the New York Constitution equal protection discrimination and retaliation claims against all Defendants in the Second Cause of Action, the U.S. Constitution equal protection discrimination and retaliation claims against the District and the Board in the Second Cause of Action, the Title IX discrimination and retaliation claims against all Defendants (Third Cause of Action), the ADA discrimination and retaliation claims against the District and the Board (Fourth Cause of Action), and the FMLA interference and retaliation claims against all Defendants (Fifth Cause of Action) are DISMISSED with prejudice; the case shall proceed to trial against the District and the Board on the Title VII and PDA discrimination claim in the First Cause of Action; and against the individual Defendants under 42 U.S.C. ยง 1983 in the Second Cause of Action.
