MEMORANDUM-DECISION AND ORDERED, that Fords motion to dismiss (Dkt. No. 5) is GRANTED; and it is further ORDERED, that Kommers affirmative misrepresentation claim is DISMISSED without leave to amend; and it is further ORDERED, that Kommers misrepresentation-by-omission claim is DISMISSED with leave to amend; and it is further ORDERED, that if Kommer wishes to proceed with his misrepresentation-by-omission claim, he must file an amended complaint as set forth above within thirty days of the filing date of this Memorandum-Decision and Order.
