DECISION AND ORDER: Granting in part and denying in part the # 10 Motion to Dismiss for Failure to State a Claim. It is hereby ORDERED, that Plaintiff's Title VII failure-to-promote claims regarding events occurring in 2010 and 2012 are DISMISSED with prejudice. It is hereby ORDERED, that the Clerk of the Court is directed to TERMINATE Roberta Reardon as the Defendant in this action and SUBSTITUTE the New York State Department of Labor as the Defendant in her place.
