MEMORANDUM, DECISION & ORDER -- Defendants Moller, Jensen, and Jackson and defendant Pelella are dismissed from this action. Plaintiff's 8 & 9 Amended Complaint is otherwise accepted for filing. Upon receipt from Plaintiff of the documents required for service of process, the Clerk shall issue summonses and forward them, along with copies of the amended complaint, to the United States Marshal for service upon the Defendants. The Clerk shall forward a copy of the summons and amended complaint by mail to the Corporation Counsel for the City of Binghamton and the Broome County Attorneys Office, together with a copy of this Memorandum Decision and Order. The Clerk will provide the superintendent of the facility, designated by Plaintiff as his current location, with a copy of Plaintiff's authorization form, and notify the official that this action has been filed and that Plaintiff is required to pay the filing fee. Clerk provide a copy of Plaintiff's authorization form to the financial deputy of the Clerk's office. A response to Plaintiffs amended complaint be filed by the Defendants or their counsel as provided for in the Federal Rules of Civil Procedure after service of process on the Defendants. All documents relating to this action be filed with the Clerk, Syracuse, New York. Any paper sent by a party to the Court, must be accompanied by a certificate showing service to opposing parties/counsel. Plaintiffs second amended and/or supplemental complaint 12 Supplemental Complaint shall be stricken from the Court's docket for failure to comply with the Courts Local Rules of Practice.
