MEMORANDUM-DECISION AND ORDER: It is hereby ORDERED that Defendants' # 19 Motion for Summary Judgment is GRANTED in part and DENIED in part. It is further ORDERED that Defendants' # 19 Motion for Summary Judgment is GRANTED as to Plaintiff's claim for violation of Article 1, ยง 11 of the New York State Constitution (Sixth Cause of Action). It is further ORDERED that Defendants' # 19 Motion for Summary Judgment is GRANTED as to Plaintiff's claim for intentional infliction of emotional distress (Seventh Cause of Action). It is further ORDERED that Defendants' # 19 Motion for Summary Judgment is GRANTED as to Plaintiff's claims of discrimination and retaliation in connection with the failure to promote her to a full-time position. It is further ORDERED that Defendants' # 19 Motion for Summary Judgment is GRANTED as to Plaintiff's claims against Defendant Lincourt. It is further ORDERED that Defendants' # 19 Motion for Summary Judgment is otherwise DENIED. It is further ORDERED that the # 26 Motion for Summary Judgment filed by Defendants Pierce, Tilbe and Ellwanger is GRANTED.
