JUDGMENT as to Timothy E. Brewer (1), Count(s) 1, Judge Munson, upon deft's plea of guilty to Count 1 of Information 2004-CR-344, orders deft sentenced to a term of imprisonment of 30 MONTHS. The Court recommends deft be designated to a Bureau of Prisons facility for the treatment of mental disorders and recommends that the deft be designated to a facility as close to home as possible. It is further ordered that the deft shall make restitution to Officer Mark Koczan, SPD, in an amount of $5,400.00 with credit for any payments already made. Deft shall make minimum monthly installment payments of at least 25% of defts gross monthly income while incarcerated and monthly installments of $50.00 or 10 % of gross income whichever is greater, after release from prison. payments shall be forwarded to the Clerk of the Court, USDC James M. Hanley Federal Building, 100 South Clinton Street, Syracuse, New York, 13261. No fine or interest is ordered on the restitution. Deft shall be placed on a Supervised Release for a term of 2 YEARS with special conditions. Special Assessment: $100.00. No fine. Parties advised of Appeal.
