MEMORANDUM-DECISION AND ORDER granting in part and denying in part 29 Motion to Dismiss; granting in part and denying in part 30 Motion to Dismiss for Failure to State a Claim: The Court hereby ORDERS that Defendants' motions to dismiss (Dkt. Nos. 29, 30) are DENIED in part as to Plaintiffs' CERCLA claims and their contractual indemnification claim against the County, and GRANTED in part as to all other claims; and the Court further ORDERS Plaintiffs to file a supplemental brief within thirty (30) days explaining why CI's ยง 113 claim should not be dismissed for failure to state a claim; and the Court further ORDERS that the Clerk of the Court serve a copy of this Memorandum-Decision and Order on all parties in accordance with the Local Rules.
