ORDER, that the Clerk issue summonses and forward them along with copies of the amended complaint to the U.S. Marshal for service upon defendants along with this order. Clerk shall forward a copy of the summons and amended complaint to the Office of the City of Utica Attorney with a copy of this order; that formal response be filed as provided in the FRCP; that all pleadings and documents are to be filed in Syracuse; Plaintiff is to notify the clerk's office of any change of address . MEMORANDUM-DECISION and ORDER, That defendant Arcuri's 48 Motion for Summary Judgment is GRANTED, and all claims against Arcuri are dismissed; that the City Defendants' 50 Motion for Summary Judgment is GRANTED as to all calims against Pylman, Julian, and the City of Utica and is GRANTED as to all claims against Amerosa with the exception of the Fourth Amendment excessive force claim against Amerosa, and as to that claim, the motion is DENIED; that defendants may disregard Ayuso's deposition notices, and that no further discovery will permitted without order of the court.
