MEMORANDUM-DECISION AND ORDER granting in part and denying in part 11 Motion to Dismiss: The Court hereby ORDERS that Defendants' motion to dismiss the amended complaint is GRANTED in part and DENIED in part in accordance with this Memorandum-Decision and Order; and the Court further ORDERS that Plaintiff's request for leave to re-plead is DENIED; and the Court further ORDERS that Plaintiff shall have THIRTY (30) DAYS from the filing date of thisMemorandum-Decision and Order to effect service on Defendant Gerould and file proof of such service with the Court; and the Court further ORDERS that, if Plaintiff fails to effect service on Defendant Gerould within THIRTY(30) DAYS of the filing date of this Memorandum-Decision and Order, Defendant Gerould will be dismissed from this action, without further order of the Court.
