REPORT AND RECOMMENDATION: RECOMMENDED, that the plaintiff's motion for summary judgment (Dkt. No. 37) be DENIED. RECOMMENDED, that plaintiff's complaint be DISMISSED in its entirety based upon his material misrepresentations to the court and abuse of the litigation process. RECOMMENDED that, if the portion of the court's report recommending dismissal based on plaintiff's misrepresentation to the court is not adopted, then defendants' motion for summary judgment (Dkt. No. 45) be GRANTED in part and DENIED in part, and that all of plaintiff's claims, with the exception of his cause of action for retaliation against defendants Jakob and Saltsman, be DISMISSED on the merits.
