REPORT AND RECOMMENDATION: RECOMMENDED, that plaintiff's claims asserted against defendant John Santamassino be dismissed, without prejudice, in the event that, no later than fourteen days following the issuance of this report and recommendation, plaintiff does not provide good cause for his failure to effectuate service upon defendant Santamassino. RECOMMENDED that defendants' motion for summary judgment (Dkt. No. 84) be granted, in part, and claims dismissed as described herein. RECOMMENDED that, in the event the above-recommendations are adopted, the claims remaining for trial are described herein. ORDERED that the clerk of the court is respectfully directed to modify the docket sheet to reflect the correct spelling of defendant Daniel Simpkins' last name. ORDERED that, because plaintiff failed to provide good cause within fourteen days following the issuance of the Report and Recommendation for his failure to effectuate service upon defendant Santamassino, plaintiff's claims asserted against defendant John Santamassino are DISMISSED without prejudice. ORDERED that defendants' motion for partial summary judgment (Dkt. No. 84) is GRANTED IN PART and DENIED IN PART as indicated herein. ORDERED that this matter is deemed trial ready, a trial scheduling order will be issued in due course and Plaintiff's request for counsel (Dkt. No. 115) will likewise be considered in due course.
