DECISION AND ORDER: ORDERED, that plaintiff's IFP Application (Dkt. No. 2) is GRANTED. ORDERED that the following claims are DISMISSED without prejudice pursuant to 28 U.S.C. § 1915(e)(2)(B) and 28 U.S.C. § 1915A(b) for failure to state a claim upon which relief may be granted: (1) Fourteenth Amendment and Eighth Amendment claims against Martuscello, Graham and the Deputy Superintendent of Security; (2) Eighth Amendment and Fourteenth Amendment claims of excessive force against McGuire and Torrigleo; and (3) claims against John Does 1, 2, 3 and 4. ORDERED that defendants Martuscello, Deputy Superintendent of Security, Graham, McGuire, Torrigleo and John Does 1, 2, 3 and 4 are DISMISSED without prejudice as defendants in this action. ORDERED, that the Clerk shall issue a summons and forward it, along with copies of the Complaint, to the United States Marshal for service upon the remaining defendant. Signed by Chief Judge Gary L.
