DECISION AND ORDER: ORDERED, that plaintiff's 5 Motion for Leave to Proceed in forma pauperis is GRANTED. ORDERED that the following claims are DISMISSED without prejudice pursuant to 28 U.S.C. § 1915(e)(2)(B) and 28 U.S.C. § 1915A(b) for failure to state a claim upon which relief may be granted: (1) Eighth Amendment claims against Ramirez; (2) claims that Ramirez failed to investigate in violation of plaintiff's constitutional rights; (3) claims thatRamirez threatened plaintiff; (4) claims that Ramirez violated DOCCS Directives; (5) claims against Koenigsmann, D'Silva, and Jane Doe. ORDERED that Ramirez, Koenigsmann, D'Silva, and Jane Doe are DISMISSED as defendants in this action. ORDERED that the Clerk shall issue summons and forward them, along with copies of the complaint, to the United States Marshal for service upon the remaining defendants. The Clerk shall forward a copy of the summons and complaint to the Office of the New York Attorney General, together with a copy of this Decision and Order. Signed by Senior Judge Gary L.
