DECISION AND ORDER: ORDERED, that plaintiff's IFP Application (Dkt. No. 2) is GRANTED. ORDERED that (1) the claims for monetary damages pursuant to RLUIPA and (2) the claims for monetary damages against the defendants in their official capacities under Section 1983 are DISMISSED with prejudice. ORDERED that all claims against defendants Annucci and McCoy are DISMISSED without prejudice in accordance with 28 U.S.C. § 1915(e)(2)(B) and 28 U.S.C. § 1915A(b) for failure to state a claim upon which relief may be granted. ORDERED that defendants Annucci and McCoy are DISMISSED without prejudice as defendants. ORDERED that the Clerk shall issue a summons and forward it, along with a copy of the complaint, to the United States Marshal for service upon defendant Miller.
