Memorandum Opinion and Order granting Melissa Lopardo's Motion for Leave to file a Second Amended Complaint (ECF # 273). The Court further finds that Defendants' Motions to Dismiss are granted in part and denied in part.219, 222 , and 232. Motion to dismiss Time-Barred Claims 221 is denied. All of Richard and Catherine Lopardos claims against Cowen&Company and S.G. Cowen are dismissed with prejudice; Counts Three, Four, Eleven of the First Amended Complaint are dismissed with prejudice; and Count Seven of the Second Amended Complaint is dismissed with prejudice. Discovery is due by 7/1/2008. Summary judgment motions shall be filed by 6/13/08 with responses due on 7/14/08. Trial of this case shall take place on 9/3/08.
