Memorandum Opinion and Order that Lee's petition is granted in part and denied in part. A conditional writ of habeas corpus under 28 U.S.C. ยง 2254 will be granted. On or before 10/01/2007, counsel for Lee in this case must file in the Supreme Court of Ohio a motion to reinstate Lee's delayed appeal, incorporating propositions of law corresponding to grounds one and two of his habeas petition. The Memorandum Opinion and Order of 08/31/2007 is also amended to the extent that it provides for a conditional writ as a remedy herein. Lee must file brief in support of ground one of the petition by 10/24/2007. The State must submits its brief in opposition to ground one by 11/26/2007. Lee may file reply brief by 12/10/2007.
