Memorandum Opinion and Order: The Court adopts the Report and Recommendation in all respects and will dismiss this petition for writ of habeas corpus. Further, pursuant to 28 U.S.C. Section 1915(a)(3), the Court certifies that an appeal from this decision could not be taken in good faith and, pursuant to 28 U.S.C. Section 2253(c), that a certificate of appealability will not be granted because Petitioner has failed to make "a substantial showing of the denial of a constitutional right." (Related Doc # 50).
