Memorandum Opinion and Order - Plaintiff filed a notice of appeal with regard to Judge Aldrich's ruling of March 30, 2006 in case number 1:04CV1741. As this matter bears directly on the present case, it is this Court's opinion that it would be premature to address the issue of the defendant's motion for summary judgment (Doc. #18) in the adversry proceeding prior to a ruling by the Sixth Circuit.
