Memorandum&Order For the reasons stated in the Order, this Court Adopts the R&R (Doc. 9) and Denies Clark's petition for a writ of habeas corpus pursuant to 28 U.S.C. ยง 2254 (Doc. 1). Accordingly, Damon Clark's case is DISMISSED. The court certifies, pursuant to 28 USC 1915(a)(3), that an appeal from this decision could not be taken in good faith, and that there is no basis on which to issue a certificate of appealability.
