(2) Granting Old Republic International Corporation's motion to dismiss for failure to state a claim (Related Document 41), without prejudice, and, applying the same legal logic, (3) Granting the sua sponte dismissal of all other corporate parent defendants, with the exception of LandAmerica Financial Group, Inc. against whom all matters are stayed due to bankruptcy. Memorandum Opinion and Order: The Magistrate Judge's Report and Recommendation (Doc. No. 102) is adopted, in part, and rejected, in part. Both of the claims in the Consolidated Complaint shall be dismissed, with prejudice, against all Defendants. Defendants' Joint Motion Dismiss for failure to state a cause of action (Doc. No. 43) is granted, and Defendant Old Republic's Motion to Dismiss (Doc. No. 41) is also granted. Defendant Stewart's Motion to Dismiss (Doc. No. 42) is denied as moot.
