Memorandum of Opinion and Order For the reasons set forth herein, Plaintiff's Objection to the Report and Recommendation (ECF No. 23) is overruled. The Report and Recommendation (ECF No. 20) of the Magistrate Judge is hereby adopted and Respondent's Motion to Dismiss (ECF No. 6) is granted. Terrell West's Petition for a Writ of Habeas Corpus is dismissed as time-barred by 28 U.S.C. § 2244. The Court certifies, pursuant to 28 U.S.C. § 1915(a)(3), that an appeal from this decision could not be taken in good faith, and that there is no basis upon which to issue a certificate of appealability. 28 U.S.C. § 2253(c); Fed.
