Memorandum of Opinion and Order: This matter is before the Court upon Defendant e-Verifile.com, Inc.'s Motion to Dismiss Counts I and II of Plaintiff's First Amended Complaint (Doc. 40). Also pending is the Sterling Defendants' Motion to Dismiss First Amended Complaint in Part and to Strike Class Allegations (Doc. 43). Defendant eVerifile.com, Inc.'s motion is DENIED and the Sterling defendants' motion is GRANTED in PART and DENIED in PART.
