Memorandum Opinion and Order that the Court grants a conditional writ of habeas corpus, subject to Manley being retried by the state on the petition's second ground that Manley received ineffective assistance of counsel at trial (Related Doc # 1, 25). Accordingly, Manley's judgment and conviction in State of Ohio v. Manley is vacated and set aside, and Manley must be released from custody unless the State of Ohio commences a new trial against him within 120 days after the judgment herein becomes final.
