Further, as there is no longer a basis for Plaintiff's excessive force failure to intervene claim against Officer Costante, he is entitled to qualified immunity as well. The Defendants' motion for summary judgment (Doc. No. 20) is granted. I decline to exercise jurisdiction over Plaintiff's state law claims, those claims are dismissed without prejudice. re 21.
