Memorandum Opinion that both defendants' motions for summary judgment (Doc. Nos. 17, 18) are granted with respect to Count I and denied without prejudice as to Counts II and III. Plaintiff's motion (Doc. No. 19) for summary judgment is denied. Counts II and III will be dismissed without prejudice and plaintiff will be free to pursue them in state court.
