Memorandum of Opinion and Order For the reasons set forth herein, Plaintiff's complaint is hereby dismissed against the Ohio Department of Rehabilitation and Correction pursuant to 28 U.S.C. §§ 1915(e)(2)(B) and 1915A. The Court certifies, pursuant to 28 U.S.C. §1915(a)(3), that an appeal from this decision could not be taken in good faith. This action shall proceed only as against the CRC defendants and Dr. Kline. Memorandum of Opinion and Order For the reasons set forth herein, the parties' objections to the Report and Recommendation (ECF No. 102) of the Magistrate Judge are overruled. The Report and Recommendation is adopted in its entirety. Defendants' Motion for Summary Judgment (ECF No. 82) is granted as to all Defendants on Plaintiff's claims regarding his concussion and eye injury. Defendants' Motion for Summary judgment is denied as to Defendants Drs. Cullen, Saul, and Eddy on Plaintiff's claims about the treatment of his facial fracture during the time period from 2/5 or 6/2014 to 3/25/2014, and the Court concludes that Defendants Drs. Cullen, Saul, and Eddy are not entitled to qualified immunity with respect to this claim. Defendants' Motion forSummary Judgment is granted as to Drs. Saul, Kline, and Eddy on Plaintiff's claims regarding the treatment of his facial fracture from 3/25/2014 onward. Judge Benita Y. Pearson on 3/29/2018. Related document(s) 107, 109. (JLG)
