Order as to Charles Petties denying 85 Motion for Jenks [sic] Material prior to trial; denying 86 Motion as stated for disclosure of confidential informants and information on confidential informants, but without prejudice to renew in the event the evidence should demonstrate the use of an informant in a setting which requires disclosure of the identity of the informant under the teachings of Rovario v. United States, 77 S. Ct. 623 (1957); granting 87 Motion for production of interview reports with individuals who will not be permitted to testify at trial to the extent the interview reports constitute Brady material. In all other respects, the motion is denied; denying 88 Motion for witness list; denying 89 Motion to interview Government Witnesses; granting 90 Motion to reveal the deal made by Government with any witness expected to testify; granting 91 Request for Notice of intention to use evidence. Memorandum Opinion as to Rodney Petties 292 regarding Motion to Vacate under 28 U.S.C. 2255. The Court will conduct an evidentiary hearing requiring the return of Petties to the district. The Marshal's Office is directed to return Petties to the district by April 25, 2008, and to so notify the Court's courtroom deputy when Petties has been returned to the district. In the event Petties wishes the Court to appoint counsel to assist him during the evidentiary hearing, Petties should so notify the Court in writing by Friday, April 25, 2008. The Court will delay scheduling the evidentiary hearing until the issue of counsel, if any, for Petties has been resolved. A copy of this order mailed to defendant at FCI Morgantown.
