VACATED IN PART BY 44 ORDER Memorandum Opinion denying plaintiff's motion to remand in case 5:06CV139. The Court finds no basis for abstention and will continue with resolution of the merits of the cases. The Court finds that the adoption of Akron City Ordinance 461-2005 is a proper exercise of the powers bestowed on the City of Akron. The Court defers a ruling on the alleged due process violations in the enforcement of Ordinance 461-2005 until the plaintiffs have the opportunity for discovery which is open and shall be completed by 8/18/06.
