Memorandum of Opinion and Order: The Magistrate Judge determined that the Petition is time-barred by the applicable statute of limitations. This Court agrees as petitioner did not file his Petition within the one year period. Accordingly, for the reasons set forth in the Magistrate Judge's Report and Recommendation, the Petition for Writ of Habeas Corpus is dismissed.
