Memorandum Opinion and Order: Plaintiff's motion for the award of attorney fees pursuant to the Equal Access to Justice Act is granted, but attorney fees are awarded at the hourly rate of $125.00; plaintiff is awarded a total amount of attorney fees in the amount of $4,000.00, which represents an hourly attorney rate of $125.00 for 32 hours expended during the pendency of this case and in preparing the instant motion and reply brief (Related document 21 ; further, defendant is ordered to follow the same procedure that she has followed in other csaes, which is to determine whether plaintiff owes a preexisting debt and offset that debt within 30 days from the date of the order and thereafter directly pay to plaintiff's attorney the balance to be credited toward attorney fees.
