ORDER by Judge Susan J. Dlott DISMISSING CASE. The Court concludes that plaintiff's complaint is subject to dismissal as frivolous under 28 U.S.C. § 1915(e)(2)(B) and for lack of subject matter jurisdiction under Fed. R. Civ. P. 12(h)(3). In the alternative, the complaint is dismissed for failure to state a claim upon which relief may be granted. The complaint is hereby DISMISSED. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that for the foregoing reasons an appeal of this Court's Order would not be taken in good faith. (scot1, )
