DECISION AND ORDER - Petitioner's Motions to Stay 9 and 13 are denied as moot; 14 is denied because of proper form. Petition is to prepare a proposed amended petition with ALL the habeas corpus claims he wants the Court to consider, attach it to a new motion to amend, and file it with this Court not later than November 20, 2015. Respondent will then have the time provided by S. D. Ohio Civ. R. 7.2 to respond to the motion to amend. If the Warden opposes the motion, Jones will have seventeen days from the filing of the opposition to file a reply in support of the motion. Signed by Magistrate Judge Michael R. Merz on 11/5/2015. (kpf)(This document has been sent by regular mail to the party(ies) listed in the NEF that did not receive electronic notification.)

REPORT AND RECOMMENDATIONS - It is respectfully recommended that the Petition herein be dismissed with prejudice. Because reasonable jurists would not disagree with this conclusion, Petitioner should be denied a certificate of appealability and the Court should certify to the Sixth Circuit that any appeal would be objectively frivolous and therefore should not be permitted to proceed in forma pauperis. Objections to R&R due by 1/7/2016. Signed by Magistrate Judge Michael R. Merz on 12/18/2015. (kpf)(This document has been sent by regular mail to the party(ies) listed in the NEF that did not receive electronic notification.)
