REPORT AND RECOMMENDATIONS - IT IS RECOMMENDED THAT the pending motions to dismiss 11 14 15 19 be GRANTED based upon a lack of jurisdiction pursuant to Fed R Civ P 12(b)(1). Alternatively, the Defendants' respective motions to dismiss should be granted under Rule 12(b)(6) because Plaintiff has failed to state any cognizable federal claim against them. REPORT AND RECOMMENDATIONS re 43 Plaintiff's Motion to Vacate the Improper Default Judgment issued by Magistrate Judge Bowman who had not been consent to by Plaintiff, which is legally and lawfully required by federal law. IT IS RECOMMENDED THAT: (1) Plaintiff's motion to vacate the improper default judgment 43 should be DENIED; (2) The Court should ENJOIN AND PROHIBIT Plaintiff from filing any further motions or papers in this case, unless such motions or papers are certified as non-frivolous by an attorney. This injunctive relief should not apply to any appeal of this recommended injunctive relief to the Sixth Circuit; (3) The Clerk of Court should be specifically DIRECTED not to accept any such pleadings from Plaintiff absent compliance with the above restrictions, and should be instructed to dispose of such documents accordingly.
