ORDER AND REPORT AND RECOMMENDATION: IT IS RECOMMENDED THAT- Plaintiffs claims raised in his complaint and first amended complaint be dismissed with the exception of (1)plaintiff's Eighth Amendment claim for excessive force and (2) his conditions of confinement claim. IT IS THEREFORE ORDERED THAT- Plaintiff's motion for leave to file a first amended complaint is GRANTED. Plaintiff may proceed with his Eighth Amendment claims for excessive force against Vansickle and Patrick and his conditions of confinement against Felts, Bell, Kool, Howard, Mahlman, and Sammons Signed by Magistrate Judge Karen L.
