REPORT AND RECOMMENDATIONS re 3 Complaint: IT IS RECOMMENDED THAT The following causes of action alleged in the plaintiffs complaint be DISMISSED on the ground that plaintiff has failed to state a claim upon which relief may be granted by this Court: any claim of harassment based on alleged verbal altercations between the plaintiff and defendant; and any claims, including plaintiffs specific claims of discrimination and harassment, challenging (1) plaintiffs transfer from Unit K-3 to Unit K-1 at SOCF and (2) the disciplinary proceedings that resulted in the sanction imposed by the RIB on November 25, 2015 and reversed by SOCFs warden on December 2, 2015. ORDER - re 3 Complaint IT IS THEREFORE ORDERED THAT: Plaintiff may proceed with the following cause of action against the defendant: claim for damages based on allegations that the defendant used excessive force against plaintiff on November 24, 2015.
