Defendants Motion to Sever is DENIED, but his alternate Motion to Bifurcate (Doc. 19) is GRANTED; and Defendants Motion to Exclude Prior Conviction (Doc. 25) is GRANTED IN PART and DENIED IN PART. With respect to the United States Notice of Intent to Introduce Evidence Pursuant to F.R.E. 404(b)(2) (Doc. 27), this Court determines that evidence of Defendants acts that underpin his 2005 state law conviction will be ADMISSIBLE at trial for the sole purpose of identity.. Signed by Judge Susan J. Dlott on 4/4/17. (wam)
