ORDER granting in part and denying in part 5 Motion to Dismiss. Defendants motion to dismiss is GRANTED as to Plaintiffs First Amendment retaliation claim. That claim is DISMISSED WITH PREJUDICE. Defendants motion to dismiss is GRANTED as to Plaintiffs retaliation claims under the Rehabilitation Act, the ADA, and the Equal Protection Clause. These retaliation claims are also DISMISSED WITH PREJUDICE. Defendants motion to dismiss is MOOT as to the equal protection and due process violation claims of Mr. and Mrs. Sims.
