ORDER AND REPORT AND RECOMMENDATIONS - It is ORDERED that plaintiff may proceed with his cause of action under 42 U.S.C. § 1983 against the defendants for their participation in a disciplinary sanction allegedly imposed in violation of, or in retaliation for plaintiff s exercise of, his First Amendment right to participate in a "peaceful" hunger-strike protest at SOCF. The United States Marshal shall serve a copy of the complaint, summons, the separate Order issued this date granting the plaintiff informa paup eris status, and this Order and Report and Recommendation upon defendants as directed by plaintiff, with costs of service to be advanced by the United States. It is RECOMMENDED that Except for plaintiff s claim under 42 U.S.C. § 1983 against the defendants for their participation in a disciplinary sanction allegedly imposed in violation of, or in retaliation for plaintiff s exercise of, his First Amendment rights, the complaint should be dismissed for failure to state a claim upon which relief may be granted by this Court.
