ORDER Defendants Motion to Dismiss Claim One of the Complaint (Doc. 7) is GRANTED. Plaintiffs Motion to Dismiss Counterclaims (Doc. 12) is GRANTED IN PART AND HELD IN ABEYANCE IN PART. Encores first counterclaim is dismissed. The parties are to submit supplemental briefs on the jurisdictional issue regarding Encores second counterclaim within two weeks of the date of this Order. Finally, Plaintiffs Motion to Strike Affirmative Defenses (Doc. 13) is GRANTED IN PART AND DENIED IN PART.
