DECISION AND ENTRY - IT IS THEREFORE ORDERED THAT: 1. The parties' Joint Motion To Remand To The Commissioner (Doc. #13) is GRANTED; 2. The Clerk of Court is directed to enter Judgment in favor of Plaintiff Albert D. Feeser pursuant to Fed. R. Civ. P. 58; 3. This matter is REMANDED to the Social Security Administration pursuant to Sentence Four of 42 U.S.C. § 405(g) for further consideration consistent with this Decision and Entry and the parties' stipulation; and 4. DECISION AND ENTRY - the Court hereby ORDERS that:1. The parties' Joint Stipulation For An Award Of Attorney's Fees Under The Equal Access To Justice Act (Doc. #17) is ACCEPTED, and Defendant shall pay Plaintiffs attorney fees under 28 U.S.C. § 2412 in the total amount of $5,l00.00; 2. Plaintiffs Motion For Award Of Attorney Fees And Costs Pursuant To The Equal Access To Justice Act (Doc. #16) is denied as moot; 3. Defendant shall verify, within thirty days of this Decision and Entry, whether or not Plaintiff owes a pre-existing debt to the United States subject to offset. If no such pre-existing debt exists, Defendant shall pay the EAJA award directly to Plaintiffs attorney; and 4.
