REPORT AND RECOMMENDATIONS - It is accordingly respectfully recommended that Mr. Marcum's request for habeas corpus relief be dismissed without prejudice. Because reasonable jurists would not disagree with this conclusion, Petitioner should be denied a certificate of appealability and the Court should certify to the Sixth Circuit that any appeal would be objectively frivolous and therefore should not be permitted to proceed in forma pauperis. If the Court adopts this recommendation, it should also find there is no just reason for delay and enter a judgment on the habeas corpus claims so that Mr. Marcum can appeal if he wishes.
