Miller, in his capacity as counterclaim defendant and third-party defendant, is denied as to Canam Group, Inc.counterclaims X-XIII and Winston Towers 1988, Inc. counterclaims IX-XII. As to Winston counterclaims V-VIII; Canam Group Counterclaims VI-IX; Dutil, Gouin and Desjardin Counterclaims V-VIII; Jay wright counterclaims and third-party claims III-IV; Finloc, Inc. counterclaims V-VIII, those claims were previously dismissed voluntarily regarding PISCES judgment and are now dismissed regarding Murphy Oil Sanctions Judgment. All counterclaims and third-party claims concerning the "D&O First" policy issued to TCI by American Internat'l Specialty Ins. Co., with policy #320-83-57 and policy period from 5/31/03 until 5/31/04 are, by agreement, dismissed as moot. It is further ordered that Counts I and II of the third-party claims brought by G. L. Order that Motions for Summary Judgment filed by defendants (as to all counts in the amended complaint except Count III) is denied in large part. Summary Judgment in favor of the individual defendants is granted as to Courts IV and V but only as those counts involve the PISCES default judgment. It is further ordered that on or before 4/4/08, the parties shall submit a joint pretrial statement consistent with Local Bankruptcy Rule 7016-1.
