Order: The Eviction Motion is Denied without Prejudice to Patel's exercise, in a court of competent jurisdiction, of his rights under applicable nonbankruptcy law to obtain possession of the property. Pursuant to the Sale Confirmation Order, and to the extent not already provided therein, Patel is Granted Relief from the Automatic Stay effective immediately pursuant to 11 U.S.C. Memorandum in re: 581 Motion For Payment Of Certain Funds Held In Escrow By The Bankruptcy Clerk filed by Joseph Q. Mirarchi Legal Services PC represented by PRINCE ALTEE THOMAS (Counsel). It is concluded that this is a non-core matter as to which the Bankruptcy Court lacks authority to enter a final judgment.
